Parent Advocates Announce Lawsuit to challenge California’s New Vaccine Law in Court
Thousands of Children Lose Vaccines Exemptions, Triggering a Drive to “Revolt, Revoke, and Restore.” 

Temecula, CA – April 25, 2016 – A group of parent advocates in California announce the April 22nd filing of a lawsuit challenging SB277 – the recently enacted state law that eliminates parental choice exemptions for childhood vaccinations. The law is one of the strictest in the country, and advocates warn that other states will follow California’s example if the law remains in place.

Parents who choose to alter the law’s strict vaccine schedule, or opt out of vaccinating altogether, will be faced with the stark choice of either homeschooling their children or moving out of the state. “It’s an extremely urgent situation in California right now, with so many families suddenly losing their children’s exemptions,” said Sharon Brown, mother of two children affected by the law and one of 8 plaintiffs. 

 

Tamara Buck, the lead plaintiff, said the federal government pays families billions of dollars in compensation for vaccine injuries and deaths, yet the state government now mandates those same vaccines for every child. “The federal government has paid families nearly $3.5 billion dollars in compensation since 1986 for injuries and deaths cause by vaccines, yet our state government now mandates most of these vaccines for every child – or withholds a public education if parents don’t comply,” said Buck.

 

Sarah Lucas, another plaintiff, echoed Brown’s concern:  “My children’s vaccine reactions landed them in the ER, but they still do not qualify for medical exemptions. The law is irresponsible and dangerous, and clearly driven by pharmaceutical interests.”

The group has hired T. Matthew Phillips, Esq. “Plaintiffs allege two counts, (1) violation of the First Amendment, the “right to freedom of religion,” and (2) violation of the California Constitution, the ‘right to go to school.’  Plaintiffs seek to restore the ‘personal beliefs’ exemption to State-mandated immunization, and Plaintiffs seek to prevent a segregated school system – vaxxed and unvaxxed.  Ultimately, an L.A. judge must decide whether there exists a greater interest in educating children or in vaccinating them,” Phillips said.

 

Volunteers are soliciting donations with the goal of protecting fundamental rights of informed consent, parental choice, religious freedom, and access to a public education.
“Our group demands equal access to education for all children,” said Ms. Brown, “and we intend to fight for it.”
